Il Territorio Libero di Trieste TLT fu previsto nel 1947 all'interno del trattato di pace con l'Italia alla fine della seconda guerra mondiale. Secondo l'articolo 21 del trattato il TLT sarebbe stato riconosciuto dagli Alleati e dall'Italia, e la sua integrità e indipendenza sarebbero state assicurate dal consiglio di sicurezza delle Nazioni Unite. La mancata entrata in vigore dello statuto permanente e la mancata nomina del governatore e degli altri organi di governo del TLT determinarono uno stallo che mise in dubbio fra gli studiosi di diritto internazionale l'effettività dell'esistenza stessa di uno Stato denominato Territorio Libero di Trieste, carente di uno degli elementi costitutivi per essere definito tale , la sovranità , e quindi soggetto perennemente a un governo provvisorio militare. In tale situazione sorsero teorie internazionalistiche minoritarie secondo cui, non essendo mai sorto un TLT indipendente come previsto dal trattato di pace, l'Italia non avrebbe mai perso la propria sovranità su tutto il territorio . Di contro, la teoria predominante considerò parimenti l'insussistenza di uno Stato definibile come Territorio Libero di Trieste essendo quindi il territorio assoggettato a un regime di occupazione militare, senza essere nel frattempo soggetto a una sovranità statale . La situazione di stallo trovò de facto una soluzione con gli accordi di Londra del 1954 . (Fonte Wikipedia) . In seguito , nel 1975 la linea di demarcazione del Territorio Libero di Trieste (che divideva la Zona A dalla Zona B), con la firma del Trattato di Osimo (accordo bilaterale), venne definitivamente scelta come confine di Stato tra Italia e Jugoslavia, lo Status giuridico del Territorio Libero di Trieste non venne comunque modificato. La "Zona A" viene ancora amministrata provvisoriamente dall'Italia (precisamente dal Governo italiano, non dallo Stato) e de facto viene considerata territorio italiano , ma non de jure . Infatti la piena sovranità italiana su Trieste e territorio non è mai stata riacquisita dopo la Risoluzione n°16/1947 del Consiglio di Sicurezza delle Nazioni Unite. Con il Trattato di Pace del 1947 all'art. 21 (punto 2 e 5) la sovranità italiana sul territorio viene definitivamente persa, il trattato fù ratificato con Legge (IT) n° 3054/1952. Uno dei curiosi effetti dovuti alla situazione di stallo creatasi con la zona B fù che i triestini non ebbero la possibilità di votare al Referendun Costituzionale (Monarchia - Repubblica) , che decise che tipo di ordinamento dovesse avere lo stato italiano dopo la seconda guerra mondiale. Va precisato infine , che tutte le leggi emanate dallo Stato italiano per poter essere applicate sul territorio devono, conditio sine qua non, essere estese con specifico decreto dal Commissario di Governo per il Territorio Libero di Trieste anche ai giorni nostri.(Un ringraziamento all'amico juzzino Alessandroprof per questa interessante integrazione )
